Singapore Court Finds Man Mentally Competent

According to TSN.ua: A Singapore court has ruled that a 97-year-old man is mentally sound, clearing the way for him to marry a woman he has been in a relationship with for nearly five decades. This landmark decision resolves a bitter family dispute, which included attempts by one of his sons to have him declared mentally incapable. Such cases highlight the complex intersection of aging, autonomy, and family expectations in modern societies.

The man first married in 1950 and raised three sons. He began a relationship with his secretary in 1971, which he maintained for decades. Following the death of his wife in 2014, long-simmering family tensions came to a head.

Family Conflict and Legal Battles

In 2021, after the man suffered a fall in 2017, his second son filed a lawsuit claiming his father had developed dementia. Concurrently, the elderly man filed a counterclaim demanding the return of S$3.8 million, a move that further intensified the family rift.

Medical assessments revealed the man had mild age-related cognitive decline. However, after reviewing all evidence and the son's position, Judge Shobha Nair dismissed the son's suit. She noted that

“he fully understands the consequences of his decisions,”
which formed the basis for affirming his mental capacity. Following the verdict, the second son lodged an appeal, the outcome of which remains pending.

This ruling allows the nonagenarian to begin a new chapter with his partner of many years. The case underscores the intricate family dynamics and legal hurdles that can arise when determining an elderly person's mental fitness, with the judicial system playing a critical role in balancing individual rights against familial concerns.
