Ukrainians in Poland can leave children with temporary guardians: what you need to know.
In Poland, there is a law on assistance to military refugees from Ukraine, which includes the institution of a temporary guardian. This is especially important for children with Ukrainian citizenship who arrived in Poland after February 24, 2022, and require adolescent care.
According to the yavpl portal, temporary delegation of guardianship to someone does not deprive parents of their rights. However, it gives parents the opportunity to leave Poland calmly, knowing that the children are under supervision.
A temporary guardian can be any relative, not necessarily a close one. If there are no relatives, within 48 hours the court can require the determination of a social assistance unit.
The procedure for appointing a temporary guardian involves submitting an application to the district court at the location of the minor. A sample application can be obtained in court or downloaded online.
Participants can provide a copy of the passport, as well as additional documents, such as the parents’ consent to the appointment of a temporary guardian, copies of the child's birth certificates, and information about the future guardian.
The issue of appointing a temporary guardian is considered by the court within 3 days.
This information is very important for Ukrainian families in Poland, especially considering the legal consequences of leaving children without proper care. If the child is not under guardianship, they may be placed in a social or family institution, which may complicate the child's return to the parents.
