A resident of Lviv region achieved recognition of the inaction of the TCC in court.

In the Lviv region, the court supported a conscript who appealed to it due to the inaction of the territorial recruitment and social support center. The man, who cares for his grandmother with a group I disability, submitted an application for a deferral from mobilization along with the necessary package of documents in May 2024. However, these documents were left without consideration in the TCC despite their receipt.

The court ruling, published in the Unified State Register of Judicial Decisions, showed that the man won the lawsuit against the TCC in his favor.

The applicant demanded to recognize the inaction of the TCC as illegal and to oblige the institution to consider his documents. A representative from the Territorial Recruitment Center had no response to the lawsuit and did not explain the reasons for ignoring the request.

The court judge, after reviewing the evidence, found the actions of the TCC to be unlawful inaction. The military registration office was obliged to consider the applicant's application taking into account the court's conclusions. The decision has not yet come into force and may be appealed.

Human rights defenders note that in similar situations, TCCs sometimes demand the personal presence of the applicant, ignoring written requests, although this practice has no legal basis.
