Problems with property rights registration in Ukraine

Many Ukrainians affected by the war may not receive compensation for housing due to difficulties with registering their property rights. The Commissioner of the Verkhovna Rada for Human Rights, Dmytro Lubinets, noted that only 986 thousand applications have verified information about property rights out of 2.5 million affected households. A significant portion of applications is not reflected in the State Register of Real Rights.

The main problem is the lack of verified information about property rights in the registry, which complicates the reimbursement process. Many people face bureaucratic challenges due to a lack of documents, destruction of archival records, inaccessibility of informational references, and insufficient awareness of the property registration procedure.

Dmytro Lubinets called for more active informational work among citizens, especially among internally displaced persons, as well as for the introduction of a simplified procedure for confirming property rights without the need to send additional documents from the Bureau of Technical Inventory (BTI). The Ombudsman’s office receives requests from individuals who have lost their homes but cannot confirm their rights due to these challenges.

To address this situation, an algorithm for restoring damaged property has been developed, approved by the Procedure for Providing Compensation for the Restoration of Real Estate Objects damaged as a result of hostilities. This document also provides for the possibility of restoring property through the electronic public service “eRestoration”.

This issue is extremely relevant as it directly concerns the lives and well-being of thousands of Ukrainians who are in a difficult situation due to hostilities. As government agencies work to simplify the registration process, it is important for the affected to receive the necessary information and support.
