Can the TCC detain a foreigner.
Foreign citizens who have a permanent residence permit are not subject to military registration in Ukraine and cannot be detained or brought to the TCC. This was stated by lawyer Yuri Aivazyan.
One of the citizens of another country asked lawyers whether he could be detained by TCC employees if he only had a residence permit. This situation has already occurred in one of the Ukrainian cities.
Lawyer Yuri Aivazyan considers this a very strange situation, as a permanent residence permit does not give a person the status of a citizen of Ukraine. 'As I understand it, a person has been registered with the TCC, but there are questions on what basis, if the man does not have Ukrainian citizenship?' - emphasized the lawyer.
Documents of a citizen of Ukraine
Aivazyan explained that the passport of a citizen of Ukraine, the passport for traveling abroad, the temporary certificate, and other documents are confirmation of the status of a citizen of Ukraine. Other documents do not indicate citizenship, so the TCC has no right to detain or mobilize foreigners.
The possibility of foreigners signing contracts with the Armed Forces of Ukraine and the question of mobilization of men with dual citizenship have also been discussed earlier.
A permanent residence permit for foreigners does not mean automatic inclusion in military registration in Ukraine. The lawyer emphasized that only the passport of a citizen of Ukraine and other relevant documents are confirmation of citizenship and are the only documents that give the right to detention and mobilization by military authorities.
