According to ТСН: There are no clearly defined terms in the legislation regarding when exactly it is necessary to reserve an employee at the enterprise — this can be done either two months later or from the first day after hiring.

Military lawyer Miсhailo Lobunko from the law firm "Приходько та партнери" spoke about this.

What is needed for reservation

As the lawyer noted, in order to be eligible for reservation, a conscript must first check:

  • the presence of a valid identification document;

  • the relevance of the information about the place of residence and contacts in accordance with Law No. 3633-IX (through the military enlistment office, public service centers, or "Reserve+");

  • the absence of the status "wanted" from the military enlistment office.

"It is necessary for the conscript to clarify the personal data specified in point 2 of section II 'Final and transitional provisions' of the Law of Ukraine from April 11, 2024, No. 3633-IX 'On Introductions of Amendments to Certain Legislative Acts of Ukraine Regarding Certain Issues of Military Service, Mobilization, and Military Registration,'" Lobunko stressed.

Earlier, the lawyer explained what salary is required for reservation.

For private companies with critical infrastructure status, the salary for an employee is calculated based on the last calendar month by multiplying the minimum indicator in the country by a coefficient of 2.5. For example, if the minimum wage in December is 8,000 hryvnias, the salary for reservation must be at least 20,000 hryvnias.

For state and communal enterprises, the monthly income of an employee must not be lower than the average salary in the region for the fourth quarter of the year. This refers to the gross amount, that is, taking into account taxes and mandatory payments.

Understanding the conditions under which a reservation can be obtained will help enterprises and their employees better navigate the current situation.
