Is it possible to work while receiving a pension.
Pensioners, especially in Ukraine, often work even after reaching retirement age. That's why even in Ukrainian laws it is written when you can get a job again after recalculating your pension. This is a very important aspect of the entire labor code.
It is important to understand when you can get a job after recalculating your pension, as this often affects two pensioners at once. Moreover, it should be taken into account that the country is at war, so the question of whether pensioners can work and receive a pension is more relevant than ever against the background of rising prices and the cost of utilities.
Can disabled people receive a pension and work: how does the pension system work in this case?
The question of whether you can work and receive a pension has always been relevant. After all, the pension in Ukraine has never been very high and certainly not enough to provide a decent old age for oneself. Therefore, often after recalculating the pension, pensioners continued to work. This trend is not surprising to anyone.
At the same Time, finding a job after retirement has always been difficult for pensioners. In Ukraine, it turned out that many employers did not even hire people of retirement age, bypassing the law. Nowadays, many pensioners want to work after retirement, despite all the danger. However, there are more of them being hired now due to mobilization of men because of the war.
To understand this issue, it is worth starting with the fact that in Ukraine the conditions for retirement are determined by age and work experience. The procedure and conditions for retirement are regulated by the Law of Ukraine 'On Compulsory State Pension Insurance'. This is the main law that needs to be followed.
The retirement age is also determined for women by an article. Conditions for retirement for women:
-
Starting from April 1, 2021, the retirement age for women is 60 years old.
-
Until 2021, the retirement age for women gradually increased, starting from 55 years old.
As for men, the retirement age is 60 years. Also, the retirement is determined temporarily by work experience. At the same time, the work experience required for retirement by age also gradually increases. In 2023, for retirement at the age of 60, a 30-year insurance experience will be required. From 2028, to retire at the age of 60, 35 years of insurance experience will be required. Thus, the trend is already known for the coming years.
If a person has not accumulated the required insurance experience, there are two possible options:
-
Pension at 63. If by the age of 60 the insurance experience is from 20 to 30 years (in 2023), a pension can be awarded at the age of 63. The requirements for the experience will also gradually increase, and by 2028, 25-35 years of experience will be needed to retire at 63.
-
Pension at 65. If by the age of 60 the insurance experience is from 15 to 20 years (2023), a pension can be awarded at the age of 65. By 2028, 15-25 years of experience will be needed to retire at 65.
There are also special conditions for retirement for certain categories of employees such as:
-
Workers engaged in hazardous and strenuous work.
-
Participants in military actions.
-
People with special merits to Ukraine.
-
The disabled, children with disabilities, and persons caring for them.
These categories may be entitled to early retirement or additional pension benefits. After the end of the war, the situation in this regard may also change.
Can retirees work after retirement?
In Ukraine, the retirement age is 60 for both men and women, with the need for a certain work experience. For those who have not accumulated enough experience, there are options to retire at the age of 63 or 65 depending on the accumulated experience. Based on this law, in Ukraine retirees have the right to work after retirement, and this is regulated by the law, including the Law of Ukraine 'On Compulsory State Pension Insurance'.
Overall, retirees have the right to continue working after retirement. An employer cannot refuse to hire or dismiss a retiree solely based on their pension status. At least that should be the case within the law. And this law covers any pension (based on age, disability, length of service, etc.). Therefore, such a pensioner has the right to work in any case.
Special attention should be paid to combining a pension and income. Pensioners can combine receiving a pension with a salary. Working pensioners continue to receive their pension in full, except for some categories of pensioners for whom there may be restrictions (for example, for civil servants). Therefore, they cannot start another job after retirement.
For this, a recalculation of the pension is mandatory. If a pensioner continues to work and accumulates additional work experience, they are entitled to a pension recalculation. The pension recalculation is carried out every two years based on the additional accumulated experience and salary.
Who cannot work after retirement?
There are exceptions in this case. Firstly, it concerns pensioners who were state officials. For some categories of pensioners, such as civil servants, judges, prosecutors, etc., restrictions may be imposed on receiving a full pension while continuing to work in relevant positions. In such cases, the pensioner may be given the choice: either continue working and receive a salary, or quit the job and receive the pension.
Special attention should be paid to social pensions. Pensioners receiving social pensions (for example, disability pensions for persons without sufficient work experience) can also work, but this may affect the amount of their social assistance. In this case, the age is usually not yet retirement, as the disability status can be applicable to both young girls and boys.
Based on this, pensioners in Ukraine have the right to work after retirement, and this does not affect their right to receive a pension in full. They can combine a pension with a salary and have the opportunity to recalculate the pension based on additional work experience and income. However, there may be restrictions on combining a pension and income for some categories of pensioners.
