According to The Sun: Millions of drivers will receive £700 as a result of payouts for car loans, as the financial watchdog has announced details of a major compensation scheme.

Car financing companies are obligated to pay £8.2 billion due to breaches of legislation, which resulted in borrowers not receiving key information. This led to overpayments or missed better deals.

Payouts for drivers will start next year.

In August, the FCA announced plans for the compensation scheme.

This came after the High Court overturned a previous ruling that accused companies of failing to disclose 'hidden' commission payments to borrowers.

The High Court sided with lenders, allowing them to avoid payouts to millions of drivers for hidden commissions.

However, the FCA decided that millions of drivers may still be entitled to compensation through contracts with 'discretionary commissions' (DCAs).

DCA is when brokers and dealers raised interest rates for drivers while earning a higher commission.

Many banks have already set aside funds for payouts.

In September, BMW, which finances cars in the UK, announced a reserve of £209 million.

Close Brothers also set aside £165 million.

Lloyds Bank reserved £1.15 billion, Santander £290 million, and Barclays £95 million.

Who will receive compensation?

Compensation will be available to drivers who entered into personal contract purchase (PCP) agreements or hire purchase agreements from April 6, 2007, to November 1, 2024, when the commission was paid by the lender to the broker.

If someone did not receive information on key details such as commission payments, they will need to file a complaint.

The FCA noted that drivers do not need to use claim management companies or law firms to file a complaint. There is a template letter available on the regulator's website that can be used to make claims.

Lenders will review claims when the scheme launches, and those who have already filed complaints will be fast-tracked.

Lenders will contact drivers who have not filed complaints within six months of the scheme starting.

Only those drivers whose lenders did not notify them about one of the three agreements will receive compensation:

  • Discretionary commission agreement, where the broker was able to adjust the interest rate and earn a higher commission paid by the client
  • High commission agreement
  • Contract or connection between the lender and broker that required the client to consult the lender to obtain the loan

Thus, millions of motorists will soon be able to exercise their right to compensation through the FCA's decision. This scheme could significantly impact household budgets, as drivers will receive substantial amounts in compensation that may improve their financial situation.
