Failure to appear for the military summons: what punishment awaits offenders and how to avoid responsibility.
According to the current legislation of Ukraine, failing to appear for the summons has its consequences. However, failing to appear for the military summons is a serious violation that can lead to criminal liability.
According to a lawyer, failing to appear for the summons to clarify data or undergo a military medical commission entails administrative liability (a fine of 17,000 to 25,500 UAH). However, failing to appear for the military summons carries criminal responsibility in the form of imprisonment for up to five years.
The state may suggest applying for enlistment in the Armed Forces of Ukraine as an alternative to punishment, but it is still a criminal proceeding. In the case of failing to appear for the military summons, the search for the individual is inevitable.
Reasons for legal non-appearance at the TCC
There are serious reasons that allow postponing the fulfillment of the requirements of the summons. These include natural disasters, the death of a close relative, illness, military actions in the relevant territory, and other exceptional circumstances. It is important to have documentary evidence of these reasons.
If it is impossible to appear within the specified time, you must inform the TCC of the reason within three days from the date of the summons and visit the TCC within seven calendar days.
Every volunteer who receives a military summons must be aware of the serious consequences of failing to appear. In case of unforeseen circumstances, it is important to promptly and honestly inform the military authorities to avoid criminal liability and find an adequate solution to the situation.
