Mandatory share in inheritance: who has the right to half of the property.
According to inkorr.com: Inheritance issues often become a cause of disputes among relatives. To protect the rights of the most vulnerable family members, Ukrainian legislation provides a mechanism for the mandatory share, which belongs to them regardless of the testator's wishes.
In Ukraine, there are two main ways of inheritance: by will and by law. The law guarantees the right to a mandatory share to certain categories of heirs who, due to their age or health status, cannot provide for themselves.
According to Article 1241 of the Civil Code of Ukraine, the mandatory share is claimed by minor and underage children of the testator, his adult incapacitated children, incapacitated widow or widower, as well as incapacitated parents. They receive half of the share that would belong to them in the case of inheritance by law.
The mandatory share can include various types of property: from household items to bequests and property rights. At the same time, courts may reduce its size, taking into account the peculiarities of the relationships between the testator and the heir or other important circumstances.
Lawyers emphasize the importance of the mandatory share provision
This provision is designed to prevent the complete exclusion from the circle of heirs of those who are most in need of protection in complex inheritance situations.
The mandatory share of the inheritance guarantees the rights of the most vulnerable family members, regardless of the testator's wishes, which in turn helps avoid their complete exclusion from this process.
Thus, the mechanism of the mandatory share is an important element of Ukrainian legislation that ensures social justice in inheritance issues. This is particularly relevant in conditions where legislative norms seek to protect the rights of those who cannot independently defend their interests in inheritance disputes.
