Police Illegally Fines for Missing First Aid Kit in Car: How to Appeal.
Police Fines for Lack of First Aid Kit and Fire Extinguisher
According to inkorr.com: In Ukraine, the police actively compile protocols for the absence of a first aid kit or fire extinguisher in the car trunk. The fine for this is 340 hryvnias, however, lawyers consider such actions illegitimate.
Article 121 does not mention first aid kits or fire extinguishers for private passenger cars. The police abuse the vagueness of the law, and such fines can be successfully challenged in court, - says lawyer Andrii H. from Lviv.
According to the legislation, a first aid kit and fire extinguisher are only necessary for service vehicles, taxis, buses, and trucks. For ordinary drivers, the absence of these items may only be a reason for warning under Article 125 of the Code of Ukraine on Administrative Offenses.
Controversial Situations on the Roads
Many drivers immediately pay fines, but in cases of appeal, courts usually side with the drivers. Meanwhile, representatives of the Ministry of Internal Affairs deny any changes in the policy of inspections on the roads.
Thus, the situation with fines for the absence of a first aid kit and fire extinguisher remains ambiguous. Many drivers receive penalties, but often formal decisions can be challenged in court. This issue requires attention since it can affect the sense of justice and trust in law enforcement agencies.
