The Parliament is cancelling the deferment for students over 25 years old: lawyer's explanation.
According to ТСН: In Ukraine, there is an active discussion about the possibility of abolishing the military deferment for students who have turned 25 years old. Military lawyer Taras Borovsky explains whether this could violate the Constitution.
Lawyer's clarification
In his comment, he noted:
«This draft law does not abolish the possibility of entering an educational institution after 25 years. It only cancels the deferment for those who study in an educational institution after 25 years. Therefore, it does not contradict the Constitution in any case».
Borovsky also emphasized that these changes will not deprive conscripts of the right to study at higher educational institutions. However, such individuals may be summoned to territorial recruitment centers or mobilized upon notification.
The future of the draft law
The lawyer added that, likely, the draft law will be sent for revision.
It should be noted that the head of the Committee of the Verkhovna Rada on Education, Science and Innovation, Serhiy Babak, has announced the preparation of changes to the mobilization rules concerning the abolition of deferment for men over 25 years who seek to obtain higher, pre-higher, or vocational education.
