In Lviv, border guards did not allow a student to leave Ukraine, who wanted to participate in the international academic mobility program. To receive material and moral compensation, the young man filed a lawsuit.

Case details

According to court materials, the plaintiff studies at the 'Dnipropetrovsk State Academy of Construction and Architecture' of the Ukrainian State University of Science and Technology. In April of last year, the Canadian university Lakehead approved his application to participate in the international academic mobility program. From July to September of that year, the young man was supposed to be in Canada. A few days before the start of the internship, the student tried to leave by train from Lviv region to Poland, but the border guards did not let him pass, stating that he had not provided all the necessary documents.

Last September, the Dnipropetrovsk District Administrative Court recognized that the refusal to cross the border was illegal and canceled it. The appellate court made a similar decision.

To the Lychakiv District Court of Lviv, the young man turned to receive 50.6 thousand hryvnias as compensation for material damages and 50 thousand hryvnias for moral compensation. The boy explained that before the trip, which he had to cancel due to the refusals of border guards, he spent money on booking accommodation, purchased tickets, paid the visa fee, and rented a hotel in Lviv. He managed to get part of the money back, but had to face losses. Moreover, due to this situation, he experienced emotional stress.

Decision of the court

The judge concluded that due to the refusal to leave the country, the plaintiff suffered mental anguish, as he could not implement his plans for study and academic development. The student's lawsuit was partially satisfied: the state budget has to pay him 70.6 thousand hryvnias, of which 20 thousand hryvnias is moral compensation, and the rest is compensation for material damages.

Within 30 days from the day of the court's decision, it can be appealed by submitting an appeal.
