Transgender Identity Now Grounds for Military Registry Removal: Key Conditions Explained.
Ukraine’s General Mobilization
According to Novyny.live: Since the start of Russia’s full-scale invasion, Ukraine has maintained a general mobilization. Within this framework, the question of being removed from military registration due to medical conditions—specifically, transsexualism—has emerged. The diagnosis F64.0, which identifies transsexualism, can serve as a basis for exclusion from the military roll, but only under specific conditions that must be met.
Requirements for Military Registry Removal
Exclusion from military registration is only possible if the individual has undergone a gender change to female. The following steps are required:
- Submit a medical certificate confirming the change of sex
- Update the civil status record accordingly
- Obtain a new birth certificate and passport reflecting female gender
It is important to note that citizens removed from military registration due to health reasons are not required to undergo an annual military medical commission.
Legal expert Yuriy Ayvazyan states: 'The illness you mentioned does not, by itself, grant the right to be removed from the registry or discharged from service.'
However, he also points out that court precedents exist where service members who changed their gender to female were discharged. Vladyslav Deriy, another expert in this field, adds: 'You can demand that you be removed from the military registry of conscripts and that the relevant data be entered into the Unified State Register of Conscripts, Military Servicemen, and Reservists, called “Oberih.”'
Thus, the issue of military registry removal in cases of transsexualism in Ukraine is complex and multifaceted. Following the prescribed procedures and conditions is essential to qualify for exclusion, which in turn requires proper documentation.
This topic reflects a broader societal debate in Ukraine about LGBTQ+ rights, especially during wartime. Given the complexity of the process, it is crucial that individuals in this situation have access to adequate legal support and information. The matter also raises important questions about equality and discrimination in the context of military service.
