Who has lost their benefits?
Almost all categories of the population that have guaranteed social support have been threatened. This includes military personnel, veterans, Chernobyl survivors, widows, and families of fallen heroes, as well as former prisoners of concentration camps.
Legislative shortcomings
After the amendments were made to the Cabinet of Ministers resolution No. 389, citizens' rights enshrined in laws were significantly limited. Now discounts on utility services are provided only to families with an income of one person not exceeding 4240 hryvnias. This leads to serious financial losses for Ukrainians who spend from 600 to 1500 hryvnias more on utilities each month.
Actions in court
The lawyer emphasizes that the changes made by the government are illegal, as the resolution does not have the right to violate laws. The Constitutional Court has already confirmed that social guarantees cannot be canceled by sub-legislative acts.
Refund: advice
To restore their benefits and receive compensation for overpaid funds, citizens need to contact the Pension Fund and file a lawsuit in court. If a decision is made in favor of the plaintiff, they will not only restore their benefits but also receive reimbursement for the period from May 1, 2025.
Thus, Ukrainians entitled to benefits are facing new difficulties in receiving social assistance for utility services in 2025. Legal battles are becoming relevant to restore the violated rights of citizens and ensure the implementation of social guarantees enshrined in legislation.
