Re-registration of land after inheritance
One of the most common operations in the land market is the re-registration of land after inheritance. The ownership of the land passes to the heirs after inheritance, while its intended use remains unchanged.
The introduction of the land market has allowed for the re-registration of agricultural land.
To formalize the ownership of a land share by inheritance, the heir must:
contact a notary with an application for acceptance of the inheritance;
after the expiration of the 6-month period, contact a notary with an application for the issuance of a certificate of inheritance rights.
To obtain a certificate of inheritance rights, the following documents must be provided:
- the death certificate of the testator;
- documents confirming the family relationship of the heir to the testator;
- original documents that confirm the fact of ownership of the land share;
- a certificate of the normative monetary valuation of the land plot;
- an extract from the Land Register and certificates about the absence of encumbrances and restrictions.
After reviewing the application and documents, the notary issues the certificate of inheritance rights and registers the ownership in the State Register of Real Rights to Real Estate. From this moment, the person becomes the full owner of the inherited land share.
Next, the heir needs to contact the land management organization to obtain technical documentation for the land plot. For this, one can contact a person with a land surveyor's certificate.
Re-registration of land includes official and notarial fees. The cost of some official services: Checking the land plot (according to the registries) 68 hryvnias, conducting state registration of ownership rights to the land plot 119 hryvnias, issuing an extract from the State Register of Real Rights to Real Estate 120 hryvnias. The cost of notarial services should also be considered.
