Ukrainians can challenge the decisions regarding disability of the new commissions: procedures and nuances.

The Ministry of Health of Ukraine explained to Ukrainians about the possibility of appealing the decisions of expert teams that replaced the Medical-Social Expert Commissions (MSEC) in the context of reforming the disability determination system.

Citizens have 40 days to submit a complaint in paper or electronic form. Additionally, the Center for Assessment of the Functional State of the Individual plays an important role in ensuring the objectivity and transparency of the evaluation process of the individual's daily functioning.

According to representatives of the Ministry of Health, 'The Center for Assessment of the Functional State of the Individual carries out organizational and methodological consulting of expert teams, checks the validity of expert teams' decisions, and considers complaints about their decisions.'

It was also noted that applications are accepted from citizens across the territory of Ukraine, and expert groups are formed from medical professionals from various state medical institutions.

If there is disagreement with the experts' decision, there is a special procedure for submitting an appeal. A complaint can be submitted in paper form by sending it by mail to the Center for Assessment of the Functional State of the Individual, or in electronic form by contacting a doctor who will file the complaint in the electronic assessment system of the individual's daily functioning.

The individual wishing to appeal the experts' decision is provided with 40 calendar days to submit a complaint, the period starting from the day the individual receives an extract from the expert team's decision.

In case of missing the deadline for submitting a complaint for valid reasons, a motion for its restoration can be submitted, which will be considered by the Center within 5 working days.

The results of the examination of the complaint may confirm the challenged decision, revoke it or form a new decision.
