Postponement without VLK: the lawyer explained when TCK cannot demand a referral.
According to inkorr.com: Lawyer Daria Tarasenko explained to Ukrainians on her Facebook page that being sent to the military medical commission (VLK) is not mandatory when applying for a postponement at the territorial recruitment center.
Many conscripts are afraid that a visit to TCK for obtaining a postponement will inevitably end with a referral to VLK.
Tarasenko notes that the absence of a current VLK conclusion is not a reason for refusing to accept the application for postponement or for the postponement itself. According to Cabinet Resolution No. 560 dated 16.05.2024, individuals who have submitted an application for a postponement should not be sent to VLK.
- If the last VLK conclusion shows the category 'temporarily unfit';
- If the conscript was temporarily recognized as unfit for a certain period that has already ended.
In all other cases, demand that TCK accept your application for postponement and receive confirmation of the document acceptance. If your status is 'temporarily unfit' or the period of temporary unfitness has already expired, refusal to undergo VLK will be a violation of the law.
This information is based on the norms of current legislation. Violations of the law often occur in practice, Tarasenko clarified.
Earlier, Ukrainians were also informed about the new conditions for reservation and postponements from mobilization.
