Military personnel discharged due to health reasons can return to the Armed Forces of Ukraine: which positions are available.
A serviceman who was discharged from the Armed Forces of Ukraine due to unfitness has the right to return to military service. However, there are restrictions on the positions that such an individual can occupy. Lawyer Yuriy Aivazyan wrote about this on the 'Yurysty.UA' portal.
A citizen approached the lawyers who was discharged from military service as unfit due to health reasons (after injuries). Now the man wants to return to the ranks of the Armed Forces of Ukraine, so he inquired whether he has such a right. The citizen emphasized that he has a relation from the military unit, while the TCK refuses to consider him and does not return him to military registration.
Commenting on this situation, lawyer Yuriy Aivazyan assured that such an option is quite possible — of course, not for all positions can a previously discharged serviceman be taken, but there are positions where he can perform his duties. 'The list of positions that can be filled by such servicemen, as well as the health requirements for these persons, are determined by the Ministry of Defense of Ukraine,' the lawyer stressed.
Therefore, Aivazyan noted, the logic of TCK is unclear, which refuses to deal with this issue. 'You already have the main thing, and that is the decision of the official of the military unit, whose powers include appointing you to the relevant position, namely a recommendation letter,' the lawyer emphasized. Yuriy Aivazyan also added that if the command prohibited considering the cases of those excluded from the registry, then the issue should be resolved specifically with the command.
