Deputies wish to propose fines for Ukrainians for failure to appear at TCC on their own initiative.
Deputies propose that Ukrainians who have never been to TCC pay a fine of 8500 UAH through Reserve+. Bill No. 12093 includes such ideas.
The changes proposed in the bill will simplify the procedure for considering administrative offenses provided for by Articles 210 and 210-1 of the Code of Ukraine on Administrative Offenses. They will allow citizens who did not update their data without valid reasons to pay 50% of the minimum sanction (8500 UAH). This can be done through the electronic cabinet of the conscript, recruit or reservist.
Since updating personal data will become necessary for the use of other functions of the Electronic Cabinet, it is expected that many conscripts will take advantage of this opportunity.
Submitting an application and paying the fine through Reserve+ will allow a 50% discount on the fine amount. The bill also provides for strengthening the mechanisms of bringing to responsibility under Articles 210 and 210-1 of the Code of Administrative Offenses.
In particular, the cases in which an absentee fine can be imposed without a protocol are expanded. The return of the TCC summons with marks of non-delivery or refusal to receive is the basis for imposing a fine without a protocol.
Additionally, evidence in the case will be considered information and registry data of the Unified State Register of Conscripts, Military Obligated, and Reservists. Thus, the TCC will be able to use an extract from the Register to confirm that the person did not update their data.
The bill also provides that cases under Articles 210 and 210-1 can be considered at the place of residence of the person who committed the offense or at the place of detection of these violations.
If the fine is not paid within 30 days from the date the decision comes into legal force, the executor can proceed to compulsory enforcement. This means that the executor can freeze the accounts of the person evading payment, as well as take other actions to ensure the collection of the fine.
