Voluntary service will abolish fines: what the committee of the Rada has approved for 'draft dodgers'.


The law on fines for military registration violators will be considered in the Verkhovna Rada
The Verkhovna Rada of Ukraine will soon consider in the second reading bill No. 12093, which aims to stimulate violators of military registration to pay fines and undergo military service. The Verkhovna Rada's committee on law enforcement activities recommends adopting this law in its entirety after some amendments, reports the Judicial and Legal Newspaper.
In particular, proceedings in cases of administrative offenses provided for by Articles 210 and 210-1 of the Code of Ukraine on Administrative Offenses (violations of military registration rules and mobilization legislation) will not be initiated, and those already initiated will be closed if the person against whom proceedings are being conducted is serving in the military.
The bill also provides for the possibility for violators to pay only 50% of the minimum fine amount (8500 UAH instead of 17,000 UAH) if paid voluntarily within 10 calendar days from the day the decision comes into force.
For this, the person being held accountable can submit an application to the TCC, the Central Administration, or the regional office of the SBU, or the appropriate unit of the SGR where they are registered. In the application, it is necessary to acknowledge the fact of the violation and agree to be held accountable in the absence of the individual. This can be done personally, in writing, or through the electronic cabinet of the draftee, military serviceman, or reservist in 'Reserve+'.
The head of the TCC (or the appropriate chief in the SBU or official of the SGR unit) is obliged to verify the stated facts and issue a resolution on the case within three days after receiving the application, determining the amount of the fine at the minimum level. If the application is submitted through 'Reserve+', a copy of the resolution may be sent to the email specified in the 'Oberih' registry or to the applicant's electronic cabinet.
The resolution will be considered executed if the person pays at least 50% of the fine within 10 days. If the fine is not paid within 30 days, the resolution is subject to compulsory enforcement.
It has also become known that Ukrainians abroad will be able to pay fines from the TCC in a new way.
