According to Novyny.live: Men who qualify for a disability designation do not need to appear before a military medical commission (MMC) to secure a deferment from conscription. In fact, undergoing that evaluation prematurely could create legal trouble if the disability has not yet been officially recognized. Since Ukraine declared general mobilization on February 24, 2022, all men aged 25 to 60 are subject to call-up.
Under current regulations, having a Group 3 disability entitles a person to a mobilization deferment.
Lawyer Vladyslav Deriy explains: 'If you hold a Group 3 disability, you are legally entitled to a deferment from mobilization.'It is important to note that individuals with a disability can only be drafted if they volunteer and agree to serve under a military contract.
Automatic Extension of Deferments and the Critical Order of Paperwork
For those with a permanent disability designation, the deferment is automatically renewed every three months. However, if a man goes through the MMC and receives a rating of 'fit for service in rear units' before his disability is formally confirmed by an expert panel, he becomes eligible for immediate mobilization.
As Vladyslav Deriy warns: 'If you undergo the MMC and are classified as fit for rear service before the expert team officially grants you disability status, you will be treated as a mobilization resource.'
Therefore, it is essential to finalize the disability registration process before ever appearing before a military medical commission. Doing so prevents unintended legal consequences. Men who are eligible for disability status must fully understand their rights and options in the current mobilization environment.
