According to Novyny.live: Due to frequent power outages across Ukraine, many cafes and restaurants have been forced to rely on backup generators to stay open. In response to the increased operational costs, some establishments have begun adding a separate fee for generator use directly to customers' bills. However, Andrii Kreitor, Deputy Head of the State Service of Ukraine on Food Safety and Consumer Protection, has warned that this practice could lead to significant financial penalties for the businesses involved. This situation highlights the difficult balance businesses must strike between covering wartime operational costs and adhering to consumer protection laws.

Legal Requirements for Price Transparency

Ukrainian law, specifically the 'Consumer Rights Protection Law', mandates that consumers must be clearly informed about all services they are required to pay for. Authorities may view a separate generator fee as a violation, arguing that the generator is a tool for ensuring business continuity rather than a standalone service provided to the customer. Consequently, businesses have a legal obligation to transparently disclose all costs associated with the services they provide.

Fines for failing to provide clear price information can reach 30% of the value of the goods or services sold, with a minimum penalty of 85 hryvnias. This provides a substantial incentive for food service establishments to comply with regulations and ensure full pricing transparency. Information about any generator fee must be displayed prominently at the cash register, at the entrance to the establishment, or in another obvious location so customers can see it and factor it into their spending decisions.
