Mobilization in Ukraine: Who Cannot Be Drafted by Law and Who Is an Exception.
According to ТСН: The mobilization of conscripted men aged between 25 and 60 years is ongoing in Ukraine. However, there are cases when individuals younger than this age may also be subject to conscription.
According to information from the Free Legal Aid lawyers, Ukrainians aged 18–24 are exempt from compulsory conscription for military service.
Conditions of Mobilization
Currently, only men older than 25 years, as well as those who have completed military training and obtained an officer rank, are being conscripted.
However, there are exceptions that allow for the mobilization of young men under 25 who have military or alternative service experience, as well as those who have completed basic military training at military educational institutions, Armed Forces centers, law enforcement agencies, or educational institutions with relevant programs.
Voluntary Mobilization of Youth
Younger men can voluntarily sign a one-year contract with the Defense Forces. With this approach, they receive a salary of up to 120,000 UAH per month, social benefits, medical care, the opportunity for free education, the right to travel abroad after one year of service, as well as a guarantee of exemption from conscription for the next 12 months after completing the contract.
Anton Revenko, a member of the Ukrainian Lawyers Association, emphasizes that if a man younger than 25 is mobilized, relatives should contact the higher management of the TCK and SP to obtain legal clarification and support.
Definitions of Draftees and Conscripts
It is important to understand the difference between draftees and conscripts. A draftee is an individual who is registered at a certain draft station and can be sent for compulsory military service if they have not previously served. A conscript is a man who is on military record and has a military ID or a temporary certificate of military obligation.
Changes in Legislation
It was previously mentioned that the Verkhovna Rada of Ukraine intends to close loopholes and eliminate the possibility of evasion from military service for men over 25 who enter educational institutions. The parliament emphasizes that the admission campaign has shown that some men exploited their education in bachelor's and graduate programs for purposes other than intended.
Thus, the situation with mobilization in Ukraine remains quite complicated. Proposed legislative changes may significantly affect the rules of conscription, as well as those who attempt to evade service. The authorities aim to close gaps in the legislation to ensure fairness and effectiveness in the mobilization process.
