According to ТСН: The issue of the regularity of passing the military medical commission (MMC) remains relevant for conscripted Ukrainians. Many are wondering whether the results of the medical examination from 2025 will be automatically annulled, and whether it will be necessary to visit doctors again in 2026.

Experts from the 'Kadroland' service emphasize that the medical examination is conducted only upon an official referral from the Territorial Recruitment and Social Support Center (TRSSC).

This means that neither the employee nor the employer can independently initiate the commission process. The process begins only after the conscript receives the appropriate call-up (summons) from the TRSSC.

Employer Rights and Employee Obligations

Lawyers stress the importance of adhering to the procedures defined by Cabinet Resolution No. 1487. In this context, let’s highlight several important points:

  • The employer cannot require the employee to independently go for MMC.

  • The employee's refusal to undergo a medical examination without an official referral from the TRSSC is not considered a violation of labor discipline.

  • Even if the term of the previous commission has formally expired, without a new call from the TRSSC, the person is not obliged to visit doctors.

Status 'Partially Fit' and Examination in 2026

For those who received the status of partial fitness in 2025 (or an updated status according to the new classification), the rules remain unchanged. A repeat MMC in 2026 will be mandatory only in the presence of a personal referral.

It is also worth noting that the parliament has supported draft law No. 13335. This document provides that conscripts not registered with the TRSSC or who are wanted may be temporarily hired and have reserving formalized.

Temporary employment and reserving can last no more than 45 calendar days from the date of signing the employment contract and can be provided no more than once a year.

Thus, the issue of passing the MMC remains an important aspect for many Ukrainian conscripts. The updating of legislation and a clear understanding of one’s rights and obligations can significantly simplify this process. It is necessary to pay attention to details, as changes in legislation may affect the status and employment opportunities of conscripts.
