When You Can Sell Inherited Land Without Paying Taxes.
Tax Rules for Selling Land You Inherited
According to Novyny.live: Recent legislative changes have removed the previous three-year ownership requirement for heirs. This means that people who inherit land can now sell it immediately without waiting for that period to end. The following article explains the tax implications of selling inherited plots and outlines the specific conditions under which no taxes are due.
Conditions for Tax-Free Sales
To avoid paying taxes when selling an inherited plot, several criteria must be met:
- The sale must be the first property transaction you complete in a calendar year.
- The land must have been acquired through inheritance.
- The plot size must fall within the limits set for free privatization, specifically:
- For standard personal farming (OSG): up to 2 hectares.
- For a residential plot in a village: up to 0.25 hectares.
If these conditions are not satisfied, the seller must pay a 5% personal income tax plus a 5% military levy. Heirs who do not meet the listed requirements will therefore owe these taxes when selling their inherited land.
It is also important to note that if you sell an inherited plot and another property within the same year, the second transaction automatically becomes taxable. As a result, heirs should carefully plan their real estate deals to avoid unexpected tax bills.
Understanding the tax rules for inherited land is essential for anyone planning to sell such property. Meeting all the conditions can help prevent unnecessary financial costs.
Eliminating the three-year ownership rule simplifies the process of selling inherited land, which could have a positive impact on Ukraine's real estate market.
