TCU cannot impose fines without a summons: when the penalty is illegal.
Military Obligations and Violations of Military Registration
It turns out that a conscript citizen can be fined for violating the rules of military registration. Lawyer Yuriy Ayvazyan shared this information on the portal 'Yuristy.UA'.
The Process of Imposing a Fine
Once, a citizen approached the lawyers asking whether he could be fined for violating the rules of military registration, specifically for ignoring a summons. The lawyer's response was as follows:
'Typically, the process of imposing a fine begins with the drafting of a protocol and the subsequent decision by the head of the Territorial Recruitment Center to impose an administrative penalty.'
Requirement for Drafting a Protocol
According to Ayvazyan, for a protocol to be drafted and a fine to be imposed, the conscript must be present in person. The only exception is the formal notification of the citizen regarding the consideration of the case.
Thus, if the citizen was not notified of a possible fine from the TCU, he cannot be fined.
