If a conscript citizen has filed a lawsuit against the territorial recruitment center, it does not protect him from mobilization. To ensure that he does not receive a mobilization order before the court's decision is made, one important step must be taken.

Attorney Yuriy Aivazian wrote about this on the 'Yurists.UA' portal.

A citizen approached the lawyers, mentioning that he plans to sue the territorial recruitment center. The man asked whether the TRC can mobilize him during the consideration of the lawsuit in court.

'Unfortunately, challenging the actions of the TRC in court does not protect the conscript from mobilization,' attorney Yuriy Aivazian explained in response to the citizen.

The lawyer explained how the citizen should act to prevent mobilization until the court completes the consideration of his complaint. 'The only possible option is a statement to the court for securing the claim,' Aivazian emphasized. Therefore, he added, the attorney defending the citizen's rights must be aware of what can be done.

If a lawsuit is filed against the territorial recruitment center, this alone does not guarantee that the conscript will be exempt from mobilization. To avoid being drafted into the army until the court's decision is issued, it is necessary to file a statement to the court for securing the claim. Such a step can help ensure the safety of the citizen during the consideration of his case in court.
