TCCs do not have the right to detain citizens: lawyer's explanation

According to inkorr.com: Employees of Territorial Centers for Recruitment and Social Support (TCC and SP) do not have the right to detain or hold citizens, as this is a violation of the Constitution of Ukraine. This information was voiced by lawyer Oleksandr Protas on the air of the TV channel 'Pershyi'.

Lack of the right to detain and hold individuals

During the program, the host asked the lawyer: 'Do TCC and SP have the right to detain people?'. He unequivocally replied: 'They have no rights to do this at all.'

'They have no rights to do this at all,' said Protas.

The lawyer explained that the Constitution clearly prohibits the use of military formations to limit the rights of citizens, therefore TCC and SP cannot carry out such actions.

New rules for deferral from mobilization

Protas emphasized that TCC and SP are part of the Armed Forces and are subordinate to them, so the prohibition on limiting citizens' rights also applies to the employees of these institutions.

The lawyer also added that representatives of TCC and SP cannot have legitimate powers to detain or hold citizens, as this contradicts Article 17 of the Constitution of Ukraine. He stressed that this prohibition extends to the employees of these organizations as well.

This information is important for understanding the rights of citizens in Ukraine during martial law. As the issue of mobilization has become extremely relevant, it is important to know your rights and obligations. Civil awareness and knowledge of legal aspects can prevent unauthorized actions by representatives of military structures.
