The TCC cannot declare people wanted: a lawyer explained the legal grounds.
The TCC has no right to declare people wanted
According to inkorr.com: Lawyer Oleksandr Protas explained that Territorial Centers for Recruitment (TCC) do not have the authority to declare individuals wanted for evasion of mobilization. He emphasized that only law enforcement agencies can conduct a search within the framework of a criminal case if there are confirmed facts of evasion of military duties.
'A wanted status can only arise in a criminal proceeding if a person has the status of a suspect or an accused, and the investigator cannot in any way ensure their appearance for the fulfillment of their obligations,' Protas explained.
According to the legislation, TCCs are not included in the category of institutions authorized to conduct searches. Therefore, any statements about the possibility of declaring someone wanted for evasion of mobilization are false and nothing more than a myth.
This information is important for Ukrainians who may face questions regarding mobilization and their rights in this process. It is crucial to understand that TCCs do not have the right to declare citizens wanted, and this should be taken into account in similar situations.
Thus, citizens should be aware of their rights and obligations in the context of mobilization. It is important to critically assess messages from TCCs and seek legal assistance if questions arise.
