The Ministry of Justice warned about sanctions for unpaid alimony: what awaits debtors.
According to inkorr.com: The press service of the Ministry of Justice of Ukraine reported on the sanctions awaiting parents who evade alimony payments, as reported by 'Khvylya'.
According to the second part of Article 51 of the Constitution of Ukraine, parents are obliged to support their children until they reach adulthood. This is the basis for ensuring the rights of minors to receive financial support.
Two ways to collect alimony
- The voluntary procedure involves the conclusion of a notarized agreement between the parents. In case of its violations, alimony can be collected through an executive inscription by a notary.
- The judicial procedure is applied when the parties cannot reach an agreement. The court's decision on alimony collection becomes the basis for opening enforcement proceedings.
Restrictive measures for debtors
If the debt exceeds the amount of payments for four months, restrictive measures may be automatically applied to debtors. Among them are a ban on leaving the country, restrictions on the right to drive vehicles, and other sanctions.
Parents who do not fulfill their alimony obligations may be subjected to community service, fines, and even imprisonment. Alimony collection can occur either through a court decision or based on the voluntary notarized agreement concluded between the parents.
The Ministry of Justice emphasizes the seriousness of the consequences for parents who evade alimony payments. Sanctions include not only the prohibition of leaving Ukraine but also restrictions on driving vehicles, imposition of fines, and imprisonment. It is important to understand that failure to pay alimony can lead to serious legal and financial problems.
