Legal Action Taken Against Russian Judges for Unlawful Conviction of Ukrainian Serviceman

According to Espreso.tv: Ukrainian authorities have formally charged a judge from Russia’s 2nd Western District Military Court for illegally convicting a Ukrainian soldier who had been taken prisoner. The soldier, a member of the 17th Separate Kryvyi Rih Heavy Mechanized Brigade named after Kostiantyn Pestushko, was captured by Russian forces in October 2024.

In June 2025, the Russian judge issued a verdict finding the Ukrainian serviceman guilty and sentencing him to 16 years in prison. The judge is now accused of violating the laws and customs of war under Article 438, Part 1 of Ukraine’s Criminal Code. This prosecution of Ukrainian military personnel runs counter to international humanitarian law, particularly Article 99 of the Geneva Convention, which safeguards the rights of prisoners of war.
