Ukrainian courts are increasingly faced with materials created by artificial intelligence (AI). According to data from the court registry, in March 2025, the Khmelnytskyi Appeal Court considered the case of a Mercedes-Benz E200 CDI driver accused of using special signaling devices on his car. A video from TikTok, marked as “generated by AI”, was used as evidence. The court did not recognize this video as relevant and admissible evidence.

In December 2024, the Lenin District Court of Zaporizhia examined the case of a Mercedes-Benz G350 driver accused of violating traffic rules after he hit a cat and left the scene. The driver's lawyer requested to dismiss the case, but the court issued its conclusion using artificial intelligence Chat GPT.

In this regard, the Zaporizhia court emphasized that technologies should not hinder judges' critical thinking, despite Ukraine being a member of the artificial intelligence committee of the Council of Europe and the national government approved the AI development concept. Thus, AI can be a useful tool in the justice sector, but it cannot replace a judge.

The court stressed that using artificial intelligence Chat GPT as evidence in court, where the absence of an event and violation of a misdemeanor must be confirmed, is considered negligence. An order was issued stating that artificial intelligence Chat GPT is not a reliable source of scientifically confirmed information.

Moreover, Themis noted that there are no ethical standards and norms in Ukraine that regulate the use of artificial intelligence in the judiciary and the provision of professional legal assistance.

The Commercial Cassation Court, which is part of the Supreme Court, also expressed its opinion on the use of AI. In a ruling dated February 8, 2024, it was stated that artificial intelligence Chat GPT is not a reliable source of information that can replace a court decision. This undermines the authority of the judiciary.

Microsoft founder and philanthropist Bill Gates predicts that within a decade, advancements in artificial intelligence will lead to most things in the world no longer requiring human involvement.
