The Parliament proposes reservations for those who are not registered: details of the draft law.
According to inkorr.com: The discussion of a draft law is ongoing in the Verkhovna Rada, which allows for the reservation of men who have not fulfilled military registration requirements at critically important enterprises. The Committee on National Security has already recommended the adoption of this law in the second reading.
The document stipulates that for a period of up to 45 calendar days, those who: do not have military registration documents or have improperly issued them, are not registered for military service at all, have not clarified personal data, are wanted due to violations of military registration or mobilization legislation, will be subject to reservation.
As noted by the Judicial and Legal Newspaper, reservations will be granted regardless of the number of already reserved employees, but no more than once a year for each individual. At the same time, the Main Legal Department of the Verkhovna Rada indicates that the adoption of this law may lead to a reduction in legal responsibility.
Probation period for employees at enterprises
This amendment also provides for the implementation of a probation period of up to 45 days for employees who are subject to reservation. If during this period the employee does not provide the necessary military registration documents, the employer will be able to dismiss them. However, lawyers warn that the probation period should not be used as a means of coercion to fulfill military duties.
This approach does not solve the problem of personnel shortages, as in case of non-fulfillment of requirements, the employer loses the opportunity for further employment of the employee.
Additionally, a Unified Register of Military Obliged Persons has started operating in Ukraine, with data received from Territorial Recruitment Centers.
Thus, the Verkhovna Rada is discussing a draft law that allows the reservation of employees at critically important enterprises who do not fulfill military registration requirements. The establishment of a probation period for such employees raises concerns among lawyers, as it may cause staffing issues at enterprises. The situation requires careful attention to ensure a balance between the needs of the economy and the fulfillment of military obligations.
