Supreme Court Rejects Appeal in Bogdan O. Case

According to TSN.ua: The Supreme Court of Ukraine has declined to hear a cassation appeal from Bogdan O., a military recruitment official found guilty of illegally conscripting a man who was legally exempt from service. Bogdan O., an employee of a Territorial Recruitment and Social Support Center, had sought to overturn his conviction, but the court found no grounds to review the case. This ruling underscores the judiciary's role in holding mobilization officials accountable during wartime.

The victim, Volodymyr Malytskyi, received a draft summons in September 2025 despite being the sole caregiver for his 82-year-old father, Yosyp Malytskyi, who has a first-degree disability. During their interaction, Bogdan O. falsely informed Volodymyr that he was allegedly wanted by authorities, which appears to have been the pretext for his mobilization. Although sent to a training ground, Volodymyr Malytskyi was officially discharged from military service following public outcry and intervention.

Penalty and Consequences for the Official

In October, the Zolochiv District Court fined Bogdan O. 34,000 hryvnias for his role in the illegal conscription. His guilt was established under Part 2 of Article 172-14 of Ukraine's Code of Administrative Offenses. The Supreme Court issued its final decision in early February, refusing to initiate cassation proceedings, thereby letting the conviction and fine stand.

This case highlights the critical importance of adhering to legal procedures during mobilization, as it directly impacts human rights and social justice. Illegal conscription can have severe consequences not only for the individuals involved but for society at large, often provoking public outrage and eroding trust. The incident also points to the necessity for proper oversight and training within recruitment structures to prevent such abuses in the future.
