According to ТСН: The right to detain violators of military registration belongs only to the police, while representatives of the territorial recruitment and social support centers (TRSCC) can only inform. Citizens of Ukraine can appeal any unlawful actions in court or to the management. According to information, about 90-95% of mobilization measures occur without conflicts.

Who has the right to detain people during mobilization?

The politician commented on cases when military personnel detain people during mobilization measures, rather than the police, noting that such situations may be a result of human factors.

"If representatives of TRSCC have information that there is a conscript evading military registration, not fulfilling their obligations, then we have granted TRSCC the right, among other things, to notify about the need to report to TRSCC. Together with TRSCC employees, police representatives should be present. Undoubtedly, we are aware that TRSCC bodies do not have the authority to detain a person for committing any administrative or criminal offense. But the state is at war. Therefore, sometimes, human factors come into play. And the committee, the Ministry of Defense, and the General Staff always respond clearly to these facts to minimize any violations of legislation during citizen notifications," Venislavsky explained.

He noted that the detention of citizens is possible only if there are grounds and if the person commits an offense. Only the police have the right to detain.

How widespread is 'busification' and what should people do?

The MP commented on the actions of the military during detentions, emphasizing the ability of citizens to challenge unlawful actions.

"Any unlawful actions citizens of Ukraine have the right to challenge either in court or to the management," Venislavsky said.

He also emphasized that cases of 'busification', where representatives of TRSCC act without police, do not mean that the police are absent on the scene. According to the politician, such information can be used to counter mobilization measures.

"We are not 100% convinced that there were no police with TRSCC representatives. It is just that they were not filmed, and only military personnel in uniform were recorded to escalate the situation. Personally, I travel around Ukraine a lot, and when I see notification events, probably, I have never observed that the police were not present," the committee member added.

Venislavsky believes that individuals evading service sometimes consciously provoke conflicts. He assured that about 90-95% of mobilization measures occur without conflicts.

"The human factor, as I said earlier, is inevitable: violations, emotions. Sometimes those who do not want to serve, but are obliged to fulfill their duty, consciously provoke conflict situations. They film it, and then it is thrown [on social media] as a mass phenomenon. We in the committee receive statistics from the General Staff. Approximately 90-95% [of mobilization measures] occur without conflict. And only 5% occur in the form of confrontation, emotional conflict. This gets on video, is disseminated, and creates the impression that mobilization has continuous violations," the MP explained.

In the end, he noted that "mobilization does not have continuous violations, but there are problems".

It should also be noted that earlier, the spokesperson for the Kyiv TRSCC denied the existence of 'busification', calling it an emotional term. He emphasized the importance of adhering to the law during mobilization, adding that only police officers can detain individuals who do not wish to comply with the legislation.
