The Ministry of Justice explained how to properly оформити a power of attorney in 2025: key rules

Sometimes a person cannot personally participate in legal relations or perform legal actions. In such cases, a power of attorney helps — a document that allows you to transfer your powers to another person.

A power of attorney is a written document that gives another person the right to represent your interests before third parties. The representative can only perform those actions that are available to the principal themselves. They do not have the right to act for their own benefit or represent the interests of third parties, except in cases expressly provided by law.

According to Article 247 of the Civil Code of Ukraine, a power of attorney is valid until the expiration date specified in the document or until it is revoked. If no term is specified, the document is valid until revoked. The term must be indicated in words (years, months, weeks, days) and cannot depend on any event. A power of attorney without a date of execution is invalid.

It is impossible to sell real estate without the consent of the owner. For this, a general power of attorney is required, which must be notarized. This document allows for the buying and selling of real estate on behalf of the owner, while the funds always go to their account.

In Ukraine, the price for a power of attorney can range from approximately 400 to 2,700 hryvnias and more. The cost depends on its type and the complexity of registration. Additional expenses may be incurred for urgent processing or additional extracts from the registers.
