Desertion vs. Disability Discharge

According to Novyny.live: Being classified as having a disability group does not give a Ukrainian servicemember the right to abandon their post. Instead, those who wish to leave the Armed Forces of Ukraine (AFU) due to a disability must follow a formal legal process. The first step is submitting a resignation report addressed to the unit commander. It is critical to understand that going AWOL (Absent Without Leave) constitutes a serious offense that can lead to criminal charges.

To have their disability recognized for discharge purposes, the servicemember must undergo an evaluation by a Military Medical Commission. This commission's findings are mandatory—without its official conclusion, the resignation report cannot be processed. While personnel with severe health conditions are entitled to leave the AFU, they must still adhere to the proper procedure.

'You need to report to the nearest military law enforcement office,' said Yuriy Ayvazyan.

He further emphasized that 'once you are sent back to your military unit, you must immediately submit a resignation report there.' This highlights the importance of servicemembers knowing both their rights and obligations when facing a disability determination.

In short, personnel who have been assigned a disability group must understand the legal pathway to discharge and follow established rules to avoid legal repercussions related to unauthorized absence.

This information is especially vital for servicemembers, as it helps them navigate their rights during service, particularly when dealing with medical issues. When their health is at risk, a clear grasp of the resignation process can prevent further legal trouble and ensure a smooth transition to civilian status.
