Man with deferment detained at checkpoint: what lawyers say about mobilization

If a citizen who has a valid deferment from mobilization is wanted by the military registration and enlistment office (TCK), they may be detained during a document check. However, the situation regarding mobilization and fines for violating military registration, which led to the search being announced, is ambiguous.

Lawyer Serhiy Bohun wrote about this on the 'Lawyers.UA' portal.

Detention with deferment

A citizen approached the lawyers who has a formal and valid deferment and is also wanted due to failing to appear for summons.

The man inquired whether he could be detained during a check at the territorial recruitment center checkpoint.

'You can be detained and taken to TCK and SP,' said lawyer Serhiy Bohun.

Mobilization and fine — are they possible

The lawyer explained what would happen next.

The TCK does not have the right to mobilize such a citizen.

'Since you have a deferment, you should be released afterward,' emphasized Bohun.

The situation with fines differs from the case of mobilization.

'Regarding the administrative fine — it's not all that straightforward. It will be individual,' explained Serhiy Bohun.

Bohun's explanation helps clarify complex situations when a citizen simultaneously has a deferment from mobilization and is wanted for violating military registration. The validity of the legislation in these matters can be ambiguous, so it is important to have a clear understanding of one's rights and obligations.
