Kolomoisky Appeals London Court Decision in Privatbank Case.
According to ТСН: Igor Kolomoisky's lawyers have filed an appeal to the Court of Appeal against the High Court's decision in the case related to the lawsuit of JSC 'Privatbank' for the recovery of damages in case No. BL-2017-000665. This information was confirmed by Kolomoisky's representative, lawyer Oleksandr Lysak.
Review of Court Findings
Lysak noted that the Court of Appeal will review all findings presented in the decision of the first instance court. 'Until the appeal hearing is completed, the High Court of London’s decision cannot be considered final, as there is a possibility of it being overturned. In that case, all actions related to the enforcement of the first instance court's decision will be subject to immediate cancellation with compensation for expenses,' explained the lawyer.
Right to Appeal
He also added that the prior refusal of the first instance court to grant permission for an appeal does not limit the party's right to approach the Court of Appeal. 'Moreover, this refusal will be reviewed by the Court of Appeal for legality along with the main ruling in the case,' noted Lysak.
Expectations of Review
The lawyer emphasized that Igor Kolomoisky's team hopes for an effective, comprehensive review of all motives and conclusions outlined in the first instance court's ruling by an independent appellate court.
This appeal may have a significant impact on the further development of the 'Privatbank' case against Kolomoisky, as its results could change the legal status of both parties. Ukraine continues to closely monitor these court battles, which undoubtedly have serious financial and reputational consequences.
