Liquidation of the MSEC in Ukraine: what will change in the mobilization law.
The Verkhovna Rada of Ukraine has approved a draft law that introduces amendments to the mobilization law regarding the provision of deferments. According to the materials of the Judicial and Legal Newspaper, the Rada adopted the Cabinet's draft law 12178 as the basis.
The changes provide for the replacement of the medical and social expertise system with an 'evaluation of the person's daily functioning' and the liquidation of the MSEC. The functions of the MSEC will be transferred to expert commissions in healthcare institutions.
The law also changes the concept of the MSEC conclusion to the conclusion of an expert team on the evaluation of the person's daily functioning. This will be necessary to obtain a deferment from being conscripted for military service if there are sick close relatives of the first or second degree of disability.
The law will come into force on January 1, 2025, and provides for the formation of expert teams to which MSEC documents and cases will be transferred. The Cabinet must approve a plan for this.
Persons with indefinite disability may undergo an evaluation of their daily functioning at their own request or by court decision. Decisions made by the MSEC and documents issued by them will be considered legal and valid.
The Cabinet will establish maximum timeframes for conducting the evaluation of a person's daily functioning. The composition of the expert team will be formed for each case, taking into account the need for specialized doctors and rehabilitation specialists.
Doctors and rehabilitation specialists who previously held the positions of heads of MSEC and have convictions for intentional criminal offenses or were involved in corrupt actions will not have the right to conduct evaluations. Information about doctors and specialists who have such rights will be available on the official website of the relevant medical institutions.
It should be noted that Ukraine plans to abolish deferments from mobilization.
