Court in Lviv Upholds Mobilization Despite Tumor Diagnosis.
According to Novyny.live: In a recent ruling, the Lviv District Administrative Court rejected a lawsuit from a man challenging his mobilization after a tumor was discovered. The case centers on an individual who was initially declared fit for service, only to later receive a diagnosis of a growth, yet the court decided not to overturn the earlier decision.
The court reviewed the man's mobilization case, which began when an ad hoc military medical commission deemed him healthy on November 14, 2025. However, during a medical check-up on March 1, 2026, a tumor was identified, prompting him to appeal the original fitness ruling. Despite this new evidence, the court, in case number 380/3112/26, maintained the conclusion that he was fit for military duty, leaving him subject to mobilization.
This situation highlights the intricate legal and medical challenges surrounding mobilization in Ukraine, particularly during wartime. The decision may set a precedent for future cases where individuals with serious health issues attempt to contest their draft status. It also underscores that any changes in a conscript's health condition may still require fresh medical evaluations and further legal proceedings.
