In Vinnytsia region, the court sentenced a draft dodger to 3 years in prison: details of the case.
The Tomashpil District Court in the Vinnytsia region has issued a verdict in the case of evasion of military service during mobilization. The man claimed in court that he was forced to sign the summons.
The man tried to evade mobilization
The defendant is a resident of Transcarpathia, a conscripted man who, by the decision of the military medical commission dated October 22, 2024, was recognized as fit for service and received a combat summons requiring him to report the next day to be sent to the military unit. However, at the specified time, he did not appear without any legal grounds for deferment.
In court, the accused admitted that he signed the summons but claimed he did so under pressure and in a state of poor health after a conflict with police and military recruiting center officials. He insisted that he considers the norms of mobilization legislation unconstitutional, as well as citing the need to support his sick wife and his own religious beliefs.
Witnesses from the military enlistment office confirmed that the man was issued a referral to the military medical commission, the results of which did not raise doubts about his fitness, and that he personally signed the combat summons indicating the date and time of departure. According to witnesses, there were no unlawful actions against him, and after failing to appear for the summons, he stopped communicating.
The court, having examined the testimonies of the parties and written evidence, concluded that the accused deliberately evaded the draft during mobilization, thereby violating the process of staffing the Armed Forces of Ukraine.
As a result, the man was found guilty under Article 336 of the Criminal Code of Ukraine and sentenced to three years of imprisonment to be served in penal institutions. The term will be counted from the moment of his detention for the execution of the sentence.
