Unfinished Education - Can the TCC Refuse a Deferral.
Interesting information about deferral from mobilization for students who have not completed previous education and are studying at a lower educational level appeared on the 'Jurists.UA' portal. Lawyer Angelina Lysak explained how to try to change the data in the unified state electronic education database through the court.
Deferral for Students
Due to the general mobilization in Ukraine, certain categories of conscripts may receive a deferral from conscription. This includes students, but there are certain nuances to be aware of.
For example, if you have not completed your previous higher education and are now studying at a lower level, then the Unified State Electronic Education Database will not grant you a deferral. However, as the lawyer noted, there is a chance to change this situation through a judicial process.
Court Path to Deferral
Although the chances of success are not very high, lawyer Lysak recommends trying to change the data in the unified state electronic education database by filing a lawsuit in court. This can be a difficult process, but in some cases, it is possible to achieve the desired result.
Therefore, in cases where a student has not completed their previous education and has enrolled in another educational level, it is worth consulting specialists and considering the possibility of changing the records in the unified state electronic education database through the court to obtain a deferral from mobilization.
