It became known how many fighters returned to service this month after unauthorized leave of the unit.
In a month, approximately a hundred servicemen who first unauthorizedly left their military units were allowed to return to service. This was reported by the State Bureau of Investigation.
The Bureau emphasized that this work is facilitated by recent changes to the Criminal Code of Ukraine, which allow courts to make appropriate decisions.
Only in October, based on the materials of the SBI, courts in the Lviv, Ivano-Frankivsk, Volyn, Zakarpattia, and Ternopil regions made about a hundred decisions not to imprison the military, but to allow them to return to service. In particular, the Frankivsk District Court of the city of Lviv made the appropriate decision regarding a serviceman who, in March 2024, unauthorizedly left the location of a military unit in the Donetsk region.
In addition, at the end of October, the Volodymyr-Volynskyi City Court of the Volyn region released a serviceman from criminal liability, who last November unauthorizedly left the military unit that was stationed in Volyn. However, the man repented of his act and received written consent from the commander of the military unit to be reinstated in service. Based on this, the court decided to release him from criminal liability.
At the same Time, the SBI reminded that unauthorized leaving of a military unit or place of service without valid reasons, committed under combat conditions, is punishable by up to 10 years in prison. "But those who found themselves in such a situation for the first time have a chance to return to the ranks, help their comrades defend the country and continue to live without remorse and conflicts with the law," the law enforcement emphasized.
Recall that the Verkhovna Rada adopted in its entirety law №11322 on releasing the military from criminal liability for the first unauthorized leaving of the unit and desertion. To return to service, written consent from the unit commander is required.
It became known that servicemen who first unauthorizedly left their units began to return to the front.
By the way, the Yavoriv District Court of Lviv recognized a Lviv resident guilty of fleeing from the place of military service and sentenced him to five years in prison, despite the convict's desire to continue fighting.
