Military Enlistment Offices and Reservation Authority

According to Novyny.live: Under Ukrainian law, Territorial Centers for Recruitment and Social Support (known as TCCs) lack the legal authority to revoke a reservation (deferment) for military service. Only a duly authorized government body or the employer itself may decide to cancel such a deferment. Attorney Violetta Monastyrska of LEGAL STRATEGY emphasized that any attempt by a TCC to unilaterally revoke a reservation is unlawful.

Reservation procedures are governed by Cabinet of Ministers Resolution No. 76. According to this regulation, TCCs are only permitted to place an individual on special military registration based on a valid reservation decision. This means that only designated authorities can revoke a reservation, and only under specific, legally defined circumstances.

When a Reservation Can Legally Be Revoked

The law lists the following scenarios under which a reservation may be canceled:

  • the company has completed its mobilization assignment,
  • production or services for the Armed Forces of Ukraine have been terminated,
  • the enterprise loses its status as critical to the national economy,
  • the company is liquidated or the reservist is dismissed.

In a recent case in the Kirovohrad region, a court ruled that a TCC's fine of 17,000 hryvnias was illegal and overturned it. This ruling underscores the importance of strict compliance with reservation regulations, as wrongful actions by TCCs can lead to legal consequences and liability.

This situation highlights the necessity of rigorous adherence to the law in the military deferment process, as well as the critical role of the judiciary in protecting citizens' rights.

Established rules and procedures not only ensure stability in mobilization efforts but also prevent abuses of power by state authorities.
