Ukrainians explained whether they need to sign a gas delivery contract.
According to the article from 'Khvyliya', many Ukrainians have different perceptions of the payment for gas transportation. Some people do not understand the necessity of such expenses, while others believe it is illegal. However, ignorance of legal norms does not exempt one from their compliance.
Basics of legislation regarding the gas market in Ukraine
The Law 'On the Natural Gas Market' is the main legislative document in this field. According to this law, gas transportation services are provided only on the basis of a contract and its terms.
The standard gas transportation contract must be approved by the energy and utilities regulator - NCRECP. In case of violation of the terms of the contract, financial penalties are provided.
Public contract and accession agreement
The Civil Code defines public contracts that are applied during the provision of various services, including gas supply. Services are provided under the terms of a standard contract involving gas distribution network operators.
(Not) signed contract?
The fact of adherence to the terms of the contract is confirmed by the consumer's actions. This may involve submitting a declaration of accession, paying a bill, or consuming gas.
'Of course, the overwhelming majority of residential gas consumers did not send signed declarations of accession to their gas distribution operators...'
All those who use natural gas automatically become participants in contractual relations with the gas distribution network operator. Compliance with the terms of the contract is mandatory for all consumers.
The article examines the issue of the necessity of concluding a gas delivery contract for Ukrainians. It explains the main legal norms and requirements that regulate this area and emphasizes the mandatory nature of complying with the terms of the contract for all gas consumers.
