Ukrainians can retire before the age of 60, but not everyone: who has the right.
Ukrainians were reminded of who is entitled to a pension based on age under preferential conditions.
As reported by 'Hvylya', this was announced by the Main Office of the State Pension Fund in the Donetsk region.
The preferential pension system of the country provides special conditions for certain categories of citizens, allowing them to retire before the established age. Many Ukrainians are interested in who can fall into this category.
Indeed, workers who have worked full Time in jobs with extremely harmful and particularly difficult working conditions, regardless of the place of last employment, have the right to retire before the age of 60. This is stated in part 2 of Article 114 of the Final Provisions of the Law of Ukraine 'On compulsory state pension insurance' dated 09.07.2003 No. 1058-IV.
In particular, the right to be awarded a pension based on age under preferential conditions belongs to workers regardless of the place of last work, who worked full time in jobs with extremely harmful and particularly difficult working conditions according to List No. 1, after reaching 50 years of age and having the necessary insurance record:
- men - with an insurance record of at least 25 years, with at least 10 years in the specified jobs;
- women - with an insurance record of at least 20 years, with at least 7 years and 6 months in the specified jobs.
Since 2015, the age of women has been gradually increased from 45 to 50 years, depending on the date of birth.
In the absence of the necessary insurance record during the period until April 1, 2024, a pension based on age under preferential conditions is awarded with the presence of an employment record:
- from April 1, 2023 to March 31, 2024 - no less than 24 years and 6 months for men and no less than 19 years and 6 months for women.
Meanwhile, employees who do not have the necessary work record according to List No. 1, but have at least half of such record (for men at least 5 years, for women at least 3 years and 9 months), with the presence of the specified total record (for men at least 25 years, for women at least 20 years), a pension under preferential conditions is awarded with a reduction in the retirement age (60 years):
- for men - by 1 year for each year of such work;
- for women - by 1 year and 4 months for each year of such work.
Benefits when retiring for professions according to List No. 2
note that according to List No. 2, you can retire at the age of 55 and with the necessary insurance record:
- men - with an insurance record of at least 30 years, at least 12 years and 6 months in the specified jobs;
- women - with an insurance record of at least 25 years, with at least 10 years in the specified jobs.
Since 2015, the age of women has been gradually increased from 50 to 55 years, depending on the date of birth.
In turn, employees who do not have the necessary work record according to List No. 2, but have at least half of such record (for men at least 6 years and 3 months, for women at least 5 years), with the presence of the specified total record (for men at least 30 years, for women at least 25 years), a pension under preferential conditions is awarded with a reduction in the retirement age (60 years):
- for men - by 1 year for every 2 years and 6 months of such work;
- for women - by 1 year for every 2 years of such work.
Additionally, the State Pension Fund explained how to be awarded a pension based on age under preferential conditions.
Thus, the certification of workplaces according to work conditions should be carried out at least every five years in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 442 of 01.08.1992. If these terms are violated, periods of work over 5 years are not counted when calculating the preferential record.
It is important that special experience accumulated before 21.08.1992 requires confirmation with documents confirming the certification of the workplace.
To apply for such a pension, you need to provide not only documents confirming your identity and confirming the insurance record, but also documentation on the conducted certification of workplaces. However, there is an exception: if an enterprise is located in a temporarily occupied territory or in a combat zone, the right to a preferential pension can be confirmed based on available information on special work experience of registered persons.
If there is no information in the employment record giving the right to a preferential pension for confirming special work experience, clarifying certificates from enterprises, institutions, organizations, or their legal successors are accepted. If the enterprise is liquidated, periods of preferential work are confirmed by relevant commissions created at the main offices of the Pension Fund of Ukraine.
The certificate must indicate:
- periods of work credited to special experience;
- profession or position;
- nature of work performed;
- section, subsection, paragraph, name, or numbers of lists that provide for such work;
- primary documents during the performance of work on the basis of which the certificate was issued.
