The lawyer named the main condition for canceling the fine from the TCC.
The recently adopted law limits the validity period of fines for the search of conscripts. Now, territorial recruitment centers can carry out searches for three months, after which imposing a fine will be impossible. This is a new legislative norm that regulates the procedure for searching for conscripts and establishes the time frames for its implementation.
'Currently, there are only periods for bringing to administrative responsibility, and in your case, this is three months from the date you were put on the search list,' explained lawyer Vladyslav Derii in response to a citizen.
If the search lasts more than three months, the fine cannot be applied, and violations of administrative norms cannot be considered. According to the lawyer's explanation, the search is completed after the case is closed due to the absence of violations or simply after the established deadlines for bringing to responsibility expire. The search process can also be halted by paying the fine or appealing the decisions in court.
Therefore, this new norm provides that fines for the search of conscripts can only be applied within three months, after which they become invalid. This is an important point for understanding the rights and obligations of conscripts in the context of legislation.
