Managing partner of the law firm Prove Group Vladislav Kochkarov asserts that abolishing the appeal of decisions made by tax authorities at the regional levels of the State Fiscal Service and transferring disputes to the Ministry of Finance could help unblock about 90 billion hryvnias currently under judicial consideration between tax authorities and businesses. This statement was made during a press conference in Kyiv on April 15 this year.
Lawyers from Prove Group propose transitioning to a one-level administrative appeal of SFS decisions and using mediation procedures to resolve tax disputes through compromise. They cite examples of successful practices in the Netherlands, Germany, the United Kingdom, Australia, and the USA, where reaching a compromise resolves the majority of such disputes before court proceedings.
Vladislav Kochkarov and lawyers from Prove Group are exploring the possibility of unlocking 90 billion hryvnias that are currently under judicial consideration between tax authorities and businesses by abolishing the appeal of tax authority decisions and using mediation to resolve tax disputes before court proceedings.
